Legislator Argues Buhari Administration Is Unconstitutional

The Member-elect representing Egor and Ikpoba-Okha Federal Constituency (Edo State) at the House Representatives, Ehiozuwa Johnson Agbonayinma, has expressed concern at the composition of the incoming Government. The People’s Democratic Party politician said “a scenario” where the President, Senate President, and the Chief Justice of Nigeria all hailed from one section of the country contravened the Constitution of the Federal Republic. “We must critically look at the composition of the incoming Government.

Right now, we are faced with a likely scenario where the President, Senate President, and the Chief Justice of Nigeria all hail from one section of the country, with some particular persons still clamoring for the position of the Speaker of the House of Representative to go to the same Northern part of the Country,” Agbonayinma said.
Agbonayinma said the Constitution, citing Chapter 2 Section 14 Subsection (3), stated that the composition of the Government of the Federation or any of its agencies and the conduct of its affairs should be carried out in such a manner as to reflect the federal character of Nigeria and the need to PROMOTE national unity.

It also should command national loyalty, thereby ensuring that there should be no predominance of persons from a state or from a few ethnic or other sectional groups in that Government or in any of its agencies.The lawmaker said for fairness and equity, the formation of the incoming government should have a national outlook. “I strongly believe that in the interest of fairness and equity the formation of the incoming government should have a national outlook so as not to be judged as a sectional Government.”
