Justice Adeniyi Ademola of the Federal High Court Abuja has reserved his own ruling in an application filed by former Bayelsa State Governor, Timipre Sylva, to quash fresh charge filed against him by the Economic And Financial Crimes Commission.
The court reserved ruling in the case after parties in the suit argued the application. Counsel to the former governor, Mr Lateef Fagbemi (SAN), told the court to set aside the charges against his client on the ground that he cannot be re-arraigned on the charges that have been dismissed by the same court and that the court lacks jurisdiction to try his client again.
On his part, Counsel to the Economic and Financial Crimes Commission, Mr Rotimi Jacob, who objected to the application, told the court that the charge before it is different from the one earlier dismissed by the court last month. He said that the charge has been expanded to 50 from the 42-count charge that was dismissed by Justice Ahmed Mohammed of the same court.
Justice Ahmed Mohammed, had on June 10 dismissed one of the two charges earlier brought against him and some others by the EFCC on the ground that it amounted to an abuse of court process. pointblank news.
